TERMS & CONDITIONS

By requesting, scheduling, purchasing, or receiving services from Top Quality Roadside Assistance / TQRSA Enterprise LLC (“TQRSA”), the customer acknowledges and agrees to the following Terms & Conditions.

These terms apply to all services provided by TQRSA, including services requested by phone, text message, website, online booking, third-party dispatch, or any other method.​​

SERVICES PROVIDED

TQRSA is a mobile roadside assistant and mobile automotive service provider.

Services may include, but are not limited to:

  • Mobile tire replacement

  • New and used tire installation

  • Tire mounting and balancing

  • Tire repair/patch services

  • Spare tire installation

  • Jump starts

  • Battery services and installation

  • Vehicle lockout assistance

  • Fuel delivery

  • Mobile EV charging

  • EV low-voltage assistance

  • Mobile mechanic services

  • Towing coordination

  • Fleet roadside services

  • Other roadside or automotive services approved by TQRSA

Not every service is available at all times or in every service area.​​

SERVICE QUOTES & PRICING

All service quotes are based on the information provided by the customer at the time the quote is issued.

Pricing may be based on factors including:

  • Type of service

  • Vehicle year, make, and model

  • Tire size

  • Vehicle condition

  • Customer location

  • Distance traveled

  • Highway or roadside location

  • Time of day

  • After-hours service (7:00pm-7:00am)

  • Weather conditions

  • Required parts or equipment

  • Accessibility and safety of the vehicle

  • Additional labor required

The customer is responsible for providing complete and accurate information.

If the information provided by the customer is incorrect or the actual service conditions differ from what was originally reported, TQRSA reserves the right to adjust the service price before work is performed.

Prices are non-negotiable once quoted and accepted.​​

REQUIRED DISPATCH DEPOSIT

A deposit is required before a technician is dispatched or an appointment is confirmed.

Deposit amounts may vary depending on the service, distance, parts required, time of day, and other circumstances.

The deposit is applied toward the customer's total service balance unless otherwise stated.

ALL DISPATCH DEPOSITS ARE NON-REFUNDABLE ONCE DISPATCHED.

Once a technician has been assigned and/or dispatched toward the customer's location, the deposit will not be refunded if the customer:

  • Cancels the service

  • Changes their mind

  • Leaves the location

  • Is no longer available

  • Provides an incorrect address

  • Provides incorrect vehicle or tire information

  • Obtains assistance from another person or company

  • Repairs or moves the vehicle before our arrival

  • Refuses the service

  • Fails to respond to the technician or dispatcher

The deposit compensates TQRSA for dispatch, technician time, travel, fuel, scheduling, and resources committed to the service call.

PAYMENT POLICY

TQRSA is a cashless business.

Accepted payment methods include:

  • Zelle

  • Credit card

  • Debit card

Credit and debit card transactions may be subject to a processing fee.

Cash and Cash App are not accepted.

The remaining service balance is due before service begins or is completed, as directed by dispatch.

When a technician arrives, the technician may remain inside the service vehicle until dispatch confirms that the required payment has been received.

Technicians are not authorized to begin service based on a promise of payment after the service is completed.

Once payment is requested, the customer has 5 minutes to complete payment unless otherwise authorized by dispatch.

If payment is not received within the required timeframe, the technician may leave the location, and the service call may be considered canceled.

Any deposit already paid will remain non-refundable.

CUSTOMER READINESS & WAIT-TIME POLICY

Customers must be ready and available when the technician arrives.

The vehicle must be accessible, and the customer must provide any access necessary to perform the requested service.

TQRSA is an emergency mobile service provider and cannot hold technicians at a location for extended periods while a customer:

  • Travels to the vehicle

  • Searches for keys

  • Waits for another person

  • Attempts to obtain payment

  • Leaves the property

  • Fails to answer calls or text messages

  • Is otherwise unavailable for service

Additional waiting time may be charged at the current TQRSA wait-time rate.

TQRSA also reserves the right to leave the location rather than wait.

ETA & ARRIVAL TIMES

All estimated arrival times are estimates only and are not guaranteed arrival times.

Arrival times may change because of:

  • Traffic

  • Weather

  • Road closures

  • Previous emergency calls

  • Technician availability

  • Distance

  • Accidents

  • Construction

  • Police activity

  • Unsafe road conditions

  • Equipment issues

  • Circumstances outside TQRSA's reasonable control

A delay in arrival does not automatically entitle the customer to a refund of a dispatch deposit.

AFTER-HOURS SERVICE & $100 AFTER-HOURS FEE

Top Quality Roadside Assistance operates 24 hours a day; however, after-hours pricing applies to all service calls from 7:00 PM through 7:00 AM.

A $100 After-Hours Fee is added to the regular service price for any service dispatched during the after-hours period.

After-Hours Period: 7:00 PM – 7:00 AM
After-Hours Fee: $100.00

The $100 After-Hours Fee is in addition to the regular service price and any other applicable charges, including mileage, highway/hazard fees, parts, tires, fuel, additional labor, processing fees, or other applicable service charges.

Deposit & After-Hours Pricing

If a customer receives a quote or pays a deposit before 7:00 PM, but delays payment, confirmation, or dispatch until 7:00 PM or later, the $100 After-Hours Fee will be added before the technician is dispatched.

Paying a deposit before 7:00 PM does not lock in daytime pricing if the service is not dispatched before the after-hours period begins.

If the customer chooses not to proceed after the after-hours fee becomes applicable, any deposit that has already become non-refundable under TQRSA's cancellation and dispatch policies will remain non-refundable.

After-Hours Availability

After-hours service is subject to technician availability, location, service type, equipment availability, and safety conditions.

The $100 After-Hours Fee does not guarantee a specific arrival time.

All quoted after-hours pricing must be paid according to TQRSA's standard payment policy.

HIGHWAY & UNSAFE LOCATION SERVICES

Services performed on highways, interstate shoulders, entrance/exit ramps, high-speed roadways, or other hazardous locations may be subject to an additional highway/hazard fee.

The fee reflects the additional risk to technicians, equipment, and customers when performing roadside work near moving traffic.

TQRSA has the sole right to determine whether a location is safe enough to perform service.

A technician may refuse, stop, relocate, or discontinue service if conditions are unsafe.

Customer convenience does not override technician safety.

WEATHER CONDITIONS

Additional charges may apply when service is performed during rain, storms, extreme temperatures, snow, ice, flooding, or other hazardous weather conditions.

TQRSA reserves the right to delay, relocate, or refuse service when weather conditions create an unreasonable safety risk.

MOBILE TIRE SERVICE

Customers requesting tire service must provide the correct tire size before dispatch whenever possible.

Customers are encouraged to verify the tire size directly from the tire currently installed on the vehicle rather than relying solely on the vehicle's year, make, and model.

Tire pricing may vary based on:

  • Tire size

  • Brand

  • Availability

  • New or used condition

  • Supplier pricing

  • Distance

  • Time of service

  • Installation requirements

Tire purchases may require a larger deposit or advance payment because tires may be purchased or reserved specifically for the customer's service call.

Once a tire has been purchased, ordered, reserved, transported, mounted, or otherwise committed specifically to a customer's service request, applicable tire/parts charges may be non-refundable.

Used tires, when offered, are sold based on available inventory and are not represented as new tires.

TIRE INSTALLATION & PRE-EXISTING CONDITIONS

TQRSA is not responsible for pre-existing problems involving:

  • Wheels/rims

  • Bent or cracked rims

  • Wheel studs

  • Lug nuts

  • Wheel locks

  • Suspension components

  • TPMS sensors

  • Valve stems

  • Brakes

  • Axles

  • Wheel bearings

  • Previously damaged tires

  • Previously repaired tires

  • Corrosion

  • Improper prior installation

  • Other pre-existing mechanical conditions

Additional labor or parts required because of a pre-existing condition may result in additional charges.

JUMP START & BATTERY SERVICE

A successful jump start does not guarantee that the vehicle will continue operating.

A vehicle that does not start, shuts off again, or experiences additional electrical problems may have issues involving the battery, alternator, starter, electrical system, charging system, or other components.

TQRSA does not guarantee that a jump start will correct an underlying mechanical or electrical problem.

VEHICLE LOCKOUT SERVICES

The customer requesting a vehicle lockout represents that they are legally authorized to access the vehicle.

TQRSA may request identification, registration, proof of ownership, or other reasonable verification.

TQRSA reserves the right to refuse a lockout service when ownership or authorization cannot reasonably be established.

FUEL DELIVERY

Fuel delivery pricing may include separate charges for:

  • Service/dispatch

  • Fuel

  • Mileage

  • After-hours service

  • Specialty fuel requirements

The customer is responsible for providing the correct fuel type.

TQRSA is not responsible for damages caused by incorrect information provided by the customer regarding the vehicle's required fuel.

MOBILE EV CHARGING

TQRSA mobile EV charging is an emergency roadside charging service.

The purpose of the service is to provide enough energy to assist the vehicle in reaching a nearby charging station or safe charging location.

TQRSA does not provide or guarantee a full battery charge.

This service should be viewed similarly to emergency fuel delivery for a gasoline-powered vehicle.

Charging speed, charging amount, and estimated range gained depend on several factors, including:

  • Vehicle make and model

  • Battery state of charge

  • Battery temperature

  • Battery condition

  • Vehicle charging limitations

  • Charging communication between the vehicle and equipment

  • Weather and environmental conditions

Charging time begins when charging equipment is connected and the charging session begins.

TQRSA does not guarantee a specific number of miles of range from an emergency charging session.

EV COMPATIBILITY

Not every electric vehicle is compatible with every charging connector, adapter, or charging method.

The customer is responsible for accurately providing the EV year, make, model, and charging-port information when requested.

TQRSA is not responsible for charging limitations caused by:

  • Vehicle software

  • Vehicle hardware

  • Adapter incompatibility

  • Charging-port problems

  • Battery management systems

  • Manufacturer restrictions

  • Pre-existing battery faults

  • Vehicle configuration

  • Aftermarket modifications

If a vehicle cannot accept a charge because of a vehicle-related issue, the dispatch/service charges may still apply.

PARTS & SPECIAL-ORDER ITEMS

Parts purchased specifically for a customer's service may require advance payment.

Special-order or customer-specific parts may be non-refundable once purchased from the supplier.

Manufacturer warranties, when applicable, remain subject to the manufacturer's warranty terms.

Labor, dispatch, mileage, diagnostic, installation, and other TQRSA service charges are separate from any manufacturer's parts warranty unless expressly stated otherwise.

CANCELLATIONS

Customers may cancel before dispatch; however, any refund eligibility will depend on whether resources, parts, technicians, or other expenses have already been committed to the service request.

Once a technician has been dispatched, the dispatch deposit is non-refundable.

Cancellation after technician arrival does not eliminate charges already incurred.

NO-SHOWS & FAILURE TO RESPOND

Customers must remain reachable using the telephone number provided when requesting service.

If the customer fails to answer calls/texts, cannot be located, leaves the service location, or otherwise prevents the technician from completing the service, the call may be considered a customer cancellation/no-show.

Deposits and applicable dispatch charges will not be refunded.

THIRD-PARTY PAYMENTS

When another individual pays for a customer's service, the person requesting the service and the person receiving the service remain responsible for complying with these Terms & Conditions.

Payment by a third party does not alter TQRSA's cancellation, refund, dispatch, or service policies.

DAMAGE & PRE-EXISTING VEHICLE CONDITIONS

Customers are responsible for notifying TQRSA of any known vehicle damage, mechanical problems, aftermarket modifications, missing parts, damaged wheels, damaged locks, electrical problems, or other relevant conditions before service begins.

TQRSA is not responsible for pre-existing damage or mechanical failure unrelated to the service performed.

Photographs or video may be taken before, during, and/or after service for documentation, safety, quality-control, insurance, dispute, and payment-verification purposes.

RIGHT TO REFUSE OR TERMINATE SERVICE

TQRSA reserves the right to refuse, discontinue, or cancel service when:

  • Conditions are unsafe

  • The customer becomes threatening, abusive, aggressive, or excessively disruptive

  • The technician is being harassed

  • Payment is refused

  • Fraud is suspected

  • The customer provides materially inaccurate information

  • The requested service cannot safely be performed

  • The customer requests an illegal or unsafe action

  • Continued service could reasonably damage the vehicle, equipment, technician, or surrounding property

TQRSA maintains a zero-tolerance policy for threats, harassment, or abusive behavior toward technicians, dispatchers, contractors, or staff.

TOWING COORDINATION

When TQRSA assists a customer with locating or coordinating a towing provider, the towing company may be an independent third-party provider.

Unless the towing service is expressly performed directly by TQRSA, the third-party towing company is responsible for its own equipment, employees, pricing, insurance, transportation, and performance.

MEMBERSHIP SERVICES

TQRSA memberships are subject to the specific benefits and limitations of the membership plan purchased.

Unless otherwise stated:

  • Memberships are billed monthly.

  • A minimum 3-month commitment may apply.

  • Membership payments are non-refundable once the applicable billing period begins.

  • Benefits apply only while the membership remains active and in good standing.

  • Unused benefits do not roll over.

  • Membership does not guarantee immediate service.

  • Members receive priority subject to technician availability and operating conditions.

  • Parts, tires, batteries, fuel, additional mileage, specialty services, highway fees, after-hours fees, and other charges are not included unless specifically stated in the membership plan.

Memberships intended for personal use may not be used for commercial fleets, rideshare operations, or multiple unrelated vehicles unless approved by TQRSA.

REFUNDS

Except where otherwise required by applicable law:

  • Dispatch deposits are non-refundable after dispatch.

  • Completed service charges are non-refundable.

  • Labor already performed is non-refundable.

  • Mileage and travel charges already incurred are non-refundable.

  • Special-order parts may be non-refundable.

  • Membership payments are non-refundable once the applicable billing cycle begins.

Any refund authorized by TQRSA is made solely at TQRSA's discretion unless otherwise required by law.

CHARGEBACKS & PAYMENT DISPUTES

Customers agree to contact TQRSA directly regarding any legitimate billing or service concern before initiating a payment dispute or chargeback.

TQRSA maintains service records that may include invoices, payment records, dispatch records, GPS/arrival information, telephone/text communications, photographs, videos, and technician documentation.

TQRSA reserves the right to submit relevant documentation to banks, payment processors, insurers, or other appropriate parties when responding to a payment dispute.

Nothing in this section limits any rights a customer may have under applicable law or their cardholder agreement.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, TQRSA is not responsible for losses or damages resulting from:

  • Pre-existing vehicle conditions

  • Mechanical or electrical failures unrelated to services performed

  • Customer-provided incorrect information

  • Delays caused by traffic, weather, road closures, emergencies, or circumstances outside TQRSA's reasonable control

  • Vehicle manufacturer charging restrictions

  • EV battery or charging-system limitations

  • Third-party towing or service providers

  • Customer refusal to follow technician safety instructions

Nothing in these Terms & Conditions is intended to waive or limit liability that cannot legally be waived under applicable law.

CUSTOMER AUTHORIZATION

By requesting service and/or submitting a deposit or payment, the customer confirms that:

  1. They are authorized to request service for the vehicle.

  2. The information provided to TQRSA is accurate to the best of their knowledge.

  3. They authorize TQRSA to perform the requested service.

  4. They understand the applicable pricing and payment requirements.

  5. They have reviewed and agree to these Terms & Conditions.

Electronic acceptance, online booking, text-message authorization, verbal authorization, payment of a deposit, or allowing a technician to begin service may constitute acceptance of these terms.

VEHICLE & SERVICE DOCUMENTATION / PHOTO POLICY

Top Quality Roadside Assistance (TQRSA Enterprise LLC) requires photographic and/or video documentation of vehicles and services performed. This documentation is a mandatory condition of service and is used for service verification, quality control, fraud prevention, payment and chargeback disputes, insurance purposes, safety, and the protection of both TQRSA and its customers.

Required Documentation

Depending on the service being performed, TQRSA technicians will photograph and/or record:

  • Vehicle license plate

  • Vehicle Identification Number (VIN)

  • Front of the vehicle

  • Rear of the vehicle

  • Driver side of the vehicle

  • Passenger side of the vehicle

  • Existing vehicle damage

  • Damaged tires, wheels, batteries, parts, or other components

  • Replacement tires, batteries, parts, or equipment

  • Items removed from the vehicle

  • Items installed on the vehicle

  • Tire size and identifying information

  • Vehicle mileage/odometer when relevant

  • Service location

  • Vehicle condition before, during, and after service

  • Completed service/work

  • Other information reasonably necessary to document the service provided

Photographs may be taken before, during, and after service.

Lockout Services & Identification

For vehicle lockout services, TQRSA may require the customer or authorized person receiving access to the vehicle to present a valid government-issued driver's license or other acceptable identification.

TQRSA may photograph the identification presented as part of the service record to document the identity of the individual to whom access to the vehicle and/or keys was provided.

Additional proof of ownership or authorization may be required when necessary.

Refusal of Photographs or Documentation

Customers who do not consent to TQRSA's required service documentation will not receive service.

If a customer refuses required photographs, identification verification, VIN documentation, vehicle documentation, or other reasonable service documentation after a technician has been dispatched, TQRSA reserves the right to immediately cancel the service.

Any applicable non-refundable dispatch deposit will be forfeited and will not be refunded.

Payment of a deposit does not require TQRSA to perform a service when the customer refuses to comply with TQRSA's documentation, identification, payment, or safety policies.

Deposits Do Not Purchase Tires, Parts, or Equipment

A dispatch deposit is a payment toward the total service and reserves/initiates TQRSA's dispatch and service process. A deposit alone does not constitute full payment or purchase of any tire, battery, part, tool, equipment, or other item transported to the customer's location.

If service is canceled, refused, or cannot be completed because the customer refuses TQRSA's required documentation policy, TQRSA will not leave tires, batteries, replacement parts, tools, equipment, or other company property with the customer solely because a deposit was paid.

Ownership of any tire, battery, replacement part, or other merchandise does not transfer to the customer until all required charges for that item and service have been paid in full, unless otherwise agreed to in writing by TQRSA.

Payment Disputes & Chargebacks

TQRSA may maintain service documentation including photographs, videos, invoices, payment records, text messages, telephone records, dispatch records, technician notes, timestamps, GPS/location information, vehicle information, VIN information, license plate information, customer authorization, and proof of completed service.

In the event of a payment dispute or chargeback, TQRSA may provide relevant service documentation to the applicable bank, card issuer, payment processor, merchant services provider, insurance company, law enforcement agency, attorney, or other appropriate party as reasonably necessary to verify that the service was requested, authorized, dispatched, and/or completed.

Customer Consent

By requesting service, accepting a quote, submitting a deposit, authorizing dispatch, or allowing TQRSA to perform service, the customer acknowledges and agrees to TQRSA's Vehicle & Service Documentation / Photo Policy.

If you do not agree to the required documentation policy, do not authorize dispatch or submit payment for service.

CHANGES TO THESE TERMS

TQRSA Enterprise LLC reserves the right to modify these Terms & Conditions as business operations, services, pricing structures, or policies change.

The Terms & Conditions in effect at the time a service is requested will govern that service unless otherwise required by law.
